Several new rules came into effect in Brazil to protect children and adolescents in the digital environment. The Digital ECA entered into force on March 17; the following day, the Federal Government issued Decree No. 12,880\/2026; and on March 20, the ANPD released its first practical guidance, along with an enforcement timeline.<\/p>\n\n\n\n
The guidance is provisional and is intended to serve as an initial reference until final rules are developed and submitted to public consultation.<\/p>\n\n\n\n
Alongside the guidance, the ANPD presented a three-phase timeline.<\/p>\n\n\n\n
The first phase is already underway and focuses on app stores and proprietary operating systems, given their ability to shape the digital experience of a large number of children and adolescents. Starting in April 2026, the ANPD will launch a Call for Contributions to gather input from stakeholders on the scope and obligations of the Digital ECA.<\/p>\n\n\n\n
The second phase begins in August 2026, following the publication of more detailed rules on age verification. Monitoring will expand to other sectors, with a compliance deadline set for November 2026. A review of enforcement and sanctions rules is also expected during this period.<\/p>\n\n\n\n
The third phase starts in January 2027 and marks the transition to formal enforcement, when the ANPD will begin actively verifying whether companies are complying with their obligations.<\/p>\n\n\n\n
The timeline, however, does not limit the Authority\u2019s powers. In cases involving complaints or risks to children and adolescents, the ANPD may act at any time.<\/p>\n\n\n\n
