Cade opens investigation into competitive impacts of AI

Cases involving potential competition risks resulting from the development and integration of artificial intelligence technologies have drawn the attention of antitrust authorities across multiple countries. In Brazil, the topic has emerged as a regulatory priority, driven by the fast expansion of AI in digital products and services.

In this context, the General Superintendence of the Administrative Council for Economic Defense (SG/CADE) has launched an administrative inquiry to assess potential competitive impacts associated with the use and deployment of artificial intelligence tools in the digital environment.

The investigation is intended to determine whether current or proposed practices in the sector could affect competitive balance, restrict the activities of certain market participants, or influence access to emerging technologies.

In the initial phase, the SG will notify the potentially involved companies and gather information from the market, experts, and other relevant stakeholders. Based on the information collected, Cade may decide either to open a formal administrative proceeding or to close the case, depending on the findings.
