ANPD takes part in TSE public hearing on regulatory framework for the 2026 General Elections

ANPD participated in a public hearing convened by the Superior Electoral Court (TSE) as part of the review of draft resolutions that will govern the organization and conduct of the 2026 General Elections.

The ANPD highlighted its ongoing institutional cooperation with the TSE, including the execution of a Technical Cooperation Agreement, the issuance of joint guidance, and prior participation in regulatory discussions.

In its contributions, the Agency proposed amendments to TSE Resolution No. 23.610/2019, which regulates electoral advertising, with particular focus on digital platforms. The proposals include: (i) the provision establishing that the registration of application providers intending to offer political advertising boosting services shall be conditioned upon the submission of a Data Protection Impact Assessment (DPIA) to the Electoral Justice, with a copy forwarded, for awareness purposes, to the ANPD; and (ii) the possibility for the Electoral Justice and the ANPD to require application providers to prepare a DPIA in cases where the processing presents a high risk.

These measures aim to strengthen preventive mechanisms, enhance transparency in platform activities, and reinforce institutional coordination, while respecting each authority’s legal mandate.
