Workshop at Brazil’s Internet Forum brings together ANPD, the Federal Public Defender’s Office and experts to debate the contestation of automated decisions.

ANPD Board Member Miriam Wimmer participated in the workshop “Contesting Automated Decisions in Brazil: Current Dimensions and Perspectives”, held at the 16th Brazil Internet Forum (FIB 16) in Belém, State of Pará, organized by the Brazilian Internet Steering Committee (CGI.br) and NIC.br.

Miriam Wimmer highlighted that Article 20 of the LGPD, which grants data subjects the right to request review of decisions made solely on the basis of automated processing, presents interpretive challenges that the ANPD will need to resolve. She emphasized that contestability goes beyond mere review, encompassing the ability to understand and interpret a decision made exclusively by automated means, and to have effective instruments available to contest it.

The panel brought together representatives from the ANPD, the Federal Public Defender’s Office, FGV CTS, and the Brazilian Bar Association (OAB), and addressed the legal, regulatory, and practical dimensions of the topic.
