On September 9, the ANPD opened a public consultation to receive contributions on the update of its Supervision and Administrative Sanctioning Procedure Regulation, established by Resolution CD/ANPD No. 1/2021. As part of the social participation stage, the Agency held an online public hearing on the matter on September 24, streamed on its YouTube channel.
The draft submitted for public comment seeks to update inspection activities and procedures to align them with the powers currently exercised by the Agency. These include powers relating to the protection of children and adolescents online, as provided for in the Digital ECA, and to safeguarding users’ rights and the compliance of internet application providers, such as digital platforms, with their duties under Decree No. 12,975/2026, which updates the regulation of the Marco Civil da Internet.
The revision also takes into account the guidelines for protecting women and addressing violence against them in the digital environment, set out in Decree No. 12,976/2026, as well as the adjustments arising from the ANPD’s transformation into a regulatory agency under Law No. 15,352/2026, which strengthened the entity’s institutional autonomy and changed its organizational structure and decision-making processes.
Once the consultation is concluded, the Superintendence of Regulation will review the contributions received, consolidate the final version of the draft, and submit the document to the Board of Directors for consideration.
