Brazil’s Electoral Court sets new rules for AI in the 2026 elections

Brazil’s Superior Electoral Court (TSE) has updated the resolutions governing electoral advertising for the 2026 General Elections, introducing unprecedented provisions on the use of generative artificial intelligence in the electoral context.

The key innovation is the imposition of preventive obligations on major digital platforms. For the first time, technology companies are expressly required to anticipate electoral violations involving generative AI, rather than merely react after harm has occurred. This includes adopting technical and organizational measures to detect, flag, and mitigate the misuse of AI-generated content in electoral contexts.

The new rules also establish transparency requirements for content produced or modified using generative AI in electoral advertising and reinforce platform obligations regarding the labeling and identification of such materials.

The regulation takes immediate effect, and platforms will be given a deadline, to be defined by the TSE, to comply. Failure to meet these obligations may result in electoral sanctions, including the suspension of functionalities or restrictions on advertising revenue related to electoral campaigns.
