MJSP releases report on online age verification

The Ministry of Justice and Public Security (MJSP) released the report “Age Verification Mechanisms: analysis of contributions to the public consultation and inputs for regulating Law No. 15,211/2025,” prepared by the National Secretariat for Digital Rights in partnership with UNESCO, the National Consumer Secretariat (Senacon), and the National Data Protection Authority (ANPD). The document systematizes 70 contributions received during the public consultation held between October 15 and November 14, 2025, and provides technical inputs for regulating the Digital ECA.

Based on the results of the public consultation, the report indicates that adopting a single, strict age-verification rule for all digital services is not viable. Instead, it supports a risk-based approach, with stricter requirements for higher-risk platforms and content and simplified procedures for low-risk environments. There was also support for the adoption of interoperable standards, avoiding closed solutions, as well as for testing requirements before the legal obligations enter into force. However, significant divergences remain, particularly regarding risk-classification standards and who should provide age-verification solutions, public authorities or private entities.

According to the MJSP, the consultation results will serve as the basis for drafting the decree that will regulate the Digital ECA, whose implementation may occur in phases, especially for provisions requiring greater regulatory detail and adaptation by the private sector. The analysis was organized into nine thematic areas, covering topics ranging from the foundations of regulation to its practical impacts, including available technologies, privacy risks, implementation costs, and the need for clear rules, defined deadlines, and supplier certification.

In addition, as provided for in Decree No. 12,622/2025, the ANPD will be responsible for regulating the technical aspects, setting standards, and establishing compliance deadlines, with the aim of ensuring predictability, legal certainty, and adequate conditions for the different actors in the digital ecosystem to comply with the law.
