SEDIGI meets with adult market sectors and ANPD to discuss implementation of the Digital ECA

The National Secretary for Digital Rights (SEDIGI), part of the Ministry of Justice and Public Security (MJSP) and responsible for drafting the proposal of decree that will regulate the Digital ECA, met with representatives from the adult content products and services sector, as well as members of the Brazilian National Data Protection Agency (ANPD), to discuss the impacts and measures needed for implementation of the new legislation in these segments.

The Digital ECA, which will enter into force in March 2026, aims to strengthen the protection of children and teenagers accessing digital environments. As such, its requirements must also be observed by websites and platforms that provide adult content.

Among the main concerns raised by the sector are: defining and verifying the minimum age of users accessing such platforms, the timeframe available for compliance with the new rules, and the need to standardize applicable sanctions across the entire segment.

  • Once the legislation takes effect, age verification will become mandatory for digital platforms that:
  • Sell alcoholic beverages or cigarettes;
  • Provide pornographic content;
  • Offer dating applications;
  • Provide artificial intelligence tools with content inappropriate for minors; and
  • Operate escort service websites.
